Smoking Policy

    I am interested in knowing what other HOAs have in place for smoking policies, related to cigarettes, marijuana, and vaping.  Do you allow smoking on decks or within other Limited Common Elements?  Do allow smoking outdoors near your building(s)?  Do you have a designated smoking area either indoors or outdoors?  Any information on smoking policies would be appreciated.

    For some time, our policy has been that we do not permit smoking of any common area, including limited common areas (balconies and access walkways). We recently clarified our rules to state that vaping is not allowed and that the prohibition extends to all lawn and parking lot areas. The only place where owners or guests can smoke on our premises is inside owners' units.

    Regarding cannabis use, it is not legal in public space of condo complexes. Town of Keystone will assist in enforcement through their STR enforcement if it is a renter using cannabis in public space.

    • Public use is illegal:
      • Using Cannabis in any way — smoking, eating or vaping — isn’t allowed in public places. This includes the following outdoor and indoor areas,  and many more:

        • Parks and amusement parks.
        • Ski resorts.
        • Concert venues.
        • Businesses.
        • Restaurants, cafes or bars.
        • Common areas of apartment buildings or condominiums.

    We don't have any smoking policies at River Run Townhomes and frankly this topic has never come up at board or HOA Annual meetings....YET

    Our police is no smoking on SilverMill property. This includes all areas (decks, spa, common, etc.) identified as SilverMill.
